The IPO processes for both financial and non-financial requirements are highly regulated by the Bursa Malaysia and the Securities Commission of Malaysia respectively, notwithstanding mandatory financial reporting compliance to the Malaysian Financial Reporting Standards (“MFRS”), the International Financial Reporting Standards (“IFRS”) and other regulators’ compliances.

The Malaysian Anti-Corruption Commission (“MACC”) Act 2009 (“MACC Act 2019”) came into effect on 1 January 2009 to effectively and efficiently manage the Malaysia’s anti-corruption efforts.
On 1 June 2020, the new provision of Section 17A of the MACC Act 2009 (“S17A”) came into effect to hold directors or partners, officers, managements of companies, partnerships or limited liability partnerships (“commercial organizations”) are responsible for corrupt acts committed by their employees with the potential corporate liability of up to ten (10) times of the value of gratification or imprisonment of up to 20 years, or both, unless the commercial organizations have proven and had in place the “Adequate Procedures” as defense against any such liabilities.
